AMENDMENT OR REPEAL.

23. The Railways Ordinance, 1909. (No. 21 of 1909), -contd.

(17) Section 40, as amended by Ordinance No. 28 of 1927-the following section is sub- stituted-

40. Every person who, without the Penalty permission of the manager, rides or at- for riding tempts to ride in or upon any engine, cab on engine,

tender, or tender, or any luggage van, goods wagon luggage or other vehicle or any part thereof not van, etc. appropriated to the carriage of passengers on any railway, shall upon summary con- viction be liable to a fine not exceeding fifty dollars."

(18) Section 41-sub-section (1) is amended by the substitution of the following two para- graphs for paragraphs (a) and (b).

(a) smokes or chews tobacco, opium or other like substance either in a waiting room or in or upon any railway carriage set apart for females or non-smokers; or

(b) spits in, from or upon any railway waiting room, platform or other premises or any railway carriage.".

(19) Section 45 is amended by the substitution of the word administrator" for "ad- ministration in the seventh line.

(20) Section 50, as amended by Ordinance No. 28 of 1927, is further amended by the sub- stitution in the fourth and fifth lines, for the words and every such person who refuses to leave the railway or premises on being requested to do so ", of the words

and every person who being without lawful excuse on the railway or premises refuses to leave the same on being requested to do so ".

(21) Section 51, as amended by Ordinance No. 28 of 1927, is further amended by the insertion in the fifth line of the words ". or who suffers any animal to stray upon any railway," immediately after the word

(22) Section 54, as amended by Ordinance No. 28 of 1927, is further amended by the substitution of the words subject to modification" for "subject to be modified" in the sixth line.

(23) Section 55 the following section is sub-

stituted--

trespassing.

55.-(1) The owner of every animal Liability which trespasses or strays upon any rail- of owner way or upon any railway lands (such rail- of animal way or lands being provided with suitable fences for excluding cattle) shall upon summary conviction be liable to a fine not exceeding five dollars for each such animal.

(2) It shall be lawful for any railway official to take or drive every animal found so trespassing to the nearest police station, there to be detained until a sum of five
