Such Trade Marks have been used by the applicants in respect of Tinned provisions such as Games, Fish, Fruits, Soy and Vegetables in Class 42 for over a period of fifteen years and that the said Trade Mark (1) has duly regis- tered in the Republic of China, Singapore, Siam and Annan and the said Trade Mark (2) has been registered in the Republic of China.

The registration of the Trade Mark (2) shall

The Trade Marks have been used by the Ap- plicants in respect of Chemical substances prepared for use in medicine and pharmacy in Class 3.

The Trade Mark (1) has been used by the Applicants in respect of Flashlight torches and Flashlight cells in Class 8 for about one year.

The Trade Mark (2) has not hitherto been used by the Applicants in respect of Ghee in Class 42 but it is their intention so to use it forthwith.

The Registration of the Trade Mark (2) shall give no right to the exclusive use of the letters "SMDS".
