In exercise of the powers conferred by section 1 (2) (d) of the Emergency Powers (Defence) Act, 1939, as applied to this Colony by the Emergency Powers (Colonial Defence) Order in Council, 1959, as respectively amended by the Emergency Powers (Defence) Act, 1940, and the Emergency Powers (Colonial Defence) (Amendment) Order in Council, 1910. His Excellency the Officer Administering the Govern- ment makes the following regulations-
The Prison Rules Amendment Regulations, 1940.
1. These regulations may be cited as The Prison Rules Amendment Regulations, 1940.
2. The prison rules published ou pages 181 to 257 of the Regulations of Hong Kong, 1844-1925, are amended as follows--
Rules 328 to 330, as amended by Government Notification 660 of 21st December, 1928, and Government Notification 498 of 30th June, 1938, are rescinded and the following rules substituted-
328. Every prisoner sentenced to imprisonment for more Remission. than one month may earn remission as provided in rule 329.

329. --(1) The amount of remission shall be determined System of by marks and the mark system shall be carried out as follows-
(2) The number of marks to be earned by prisoners will be the number of days in the scntenee multiplied by four.
(3) The maximum number of marks which may be earned in one day is six. The maximum remission which may be ordinarily earned by any prisoner is one-third of the sentence.
(4) The earliest date of release en remission will be the day on which the prisoner earns the required number of marks.
() Nothing in this rule shail authorize the reduction of any period of imprisonment to be served to less than thirty days.
330.—(1) No marks shall be allowed for mere good Marks conduct except on Sunday. Prisoners entitled to marks who earned on conduct themselves well on that day shall receive six marks.

(2) Prisoners in the industrial labour classes shall be at industrial allowed marks in proportion to their industry on the same scale as other prisoners.
(3) Prisoners in hospital shall be allowed six marks per in hospital; diem.
(4) Prisoners in solitary confinement, or on No. 1 under punishment diet for breaches of prison discipline, shall be punishment. allowed only four marks a day.
