COLONIAL SECRETARY'S DEPARTMENT.

It is hereby notified for general information that by virtue of Proclamation No. 4 of 1940, published on the 14th day of June. 1940, that war had broken out between His Majesty and Italy, and by virtue of the provisions of section 18 of the Interpretation Act, 1889, section 10 of the Colonial Courts of Admiralty Act, 1890, and section 2 of the Prize Courts Act, 1894, à Warrant, under the hands of the Com- missioners for executing the office of Lord High Admiral and under the Seal of the Admiralty conferring jurisdiction upon the Supreme Court of Hong Kong in matters of Prize has become effective in relation to the said war as from the date of the said Proclamation.

It is hereby notified for general information, with refer- ence to the Emergency Powers (Defence) Act, 1939, and to the Emergency Powers (Colonial Defence) Order in Council. 1939, published respectively as Government Notifications Nos. 707 and 708 in the Gazette Extraordinary of 26th August, 1989, that the Act has been amended by the Emer- gency Powers (Defence) Act. 1940, and the Order in Council has been amended by a further Order in Council dated the 7th June. 1940.

Section I of the 1940 Act is as follows-

1. The powers conferred on His Majesty by the Emer- geney Powers (Defence) Act, 1939, (hereinafter referred to as the principal Act") shall, notwithstanding anything in that Act, include power by Order in Council to make such Defence Regulations making provision for requiring persons to place themselves, their services, and their property at the disposal of His Majesty as appear to him to be necessary or expedient for securing public safety, the defence of the realm, the maintenance of public order, or efficient prosecu tion of any war in which His Majesty may be engaged, or for maintaining supplies or services essential to the life of the community.

The Order in Council of the 7th June, 1940, provides that the 1939 Aet as modified by the 1939 Order shall apply to the territories mentioned in the Second Schedule to the 1939 Onder subject to the further modification that the provisions of the 1939 Act shall have effect as amended by the Emergency Powers (Defence) Act, 1940,

Hong Kong is one of the territories mentioned. In the Second Schedule to the 1989 Onder.
