THE HONG KONG GOVERNMENT GAZETTE, JANUARY 26, 1940.
NOW, THEREFORE, His Majesty, by virtue and in exercise of the powers conferred on Him by the Air Navigation Acts, 1920 and 1936, and the Colonial Air Navigation (Application of Acts) Orders, 1937 and 1938, and otherwise in His Majesty vested, is pleased, by and with the advice of His Privy Council, to order, and it is hereby ordered, as follows:-

22.
1. In Paragraph (1) of Article 22 of the principal Order Amendment the words preceded, in the case of a signal by radio of Article telephony, by the name of the owner of the aircraft" shall be omitted.
2. The following Article shall be inserted after Article Civil Air 22 of the principal Order :---
" Civil
Air Ensign.
22A(1) Subject as hereinafter provided the Civil Air Ensign established by the Civil Air Ensign Order, 1937, shall not be flown on any aircraft or on any ship or boat or on any building or elsewhere within the Colony.
(2) The Civil Air Ensign may be flown (a) on any British aircraft, (b) at any aerodrome situated in the Colony which is licensed under this Order. (c) by the person operating an Air Transport undertaking owning British aircraft upon or in proximity to any building occupied by him as his principal office or place of business, (d) by any person to whom per- mission in writing is granted for the purpose by the Governor, at such places and subject to such conditions as may be specified in such permission, provided that the Civil Air Ensign shall not be hoisted on board any ship or boat belong- ing to any British subject or any person under His Majesty's protection without warrant from His Majesty or from the Admiralty".

3. Article 27 of the principal Order shall be amended Amendment as follows, that is to say:-
(1) A colon shall be substituted for the full stop at the
end of paragraph (1).
(2) The following proviso shall be inserted at the end of paragraph (1):-
"Provided that, in the case of military aircraft used for the purposes of an Auxiliary Air Unit, a Civil flying school, or any other establishment in which instruction in flying is given, where such an aircraft is not commanded by a person in naval, military or air-force service detailed for the purpose, it shall be necessary to comply with the require- ments of the following provisions of this Order, that is to
say :-
(i) Article 7 in so far as it relates to the provisions of Schedule IV to this Order;
(ii) Paragraphs (1), (2) and (4) of Article 10:
(iii) Article 12; and
(iv) Article 13 ".
4. Article 30 of the principal Order shall be amended as follows, that is to say:
(1) A semi-colon shall be substituted for the full stop at the end of sub-paragraph (b).
