Trade Mark No. 1 has been used by the Applicants since the year 1884, in respect of the following goods :—

Trade Mark No. 2 has not hitherto been used by the Applicants, but it is their intention so to use it forthwith, in respect of the following goods :

Fermented Liquors and Spirits, in Class 43.

The "Caldbeck's" (word) mark and the "Lighthouse" (device) mark are associated with each other and the Caldbeck's" mark is deemed to be distinctive of the Applicants goods in Hong Kong by Order of the Court pursuant to Section 9 (5) of the Trade Marks Ordinance, 1909.
