Short title.
Meaning of "port" and
'madeira as applied to wine.

Ordinance No. 4 of 1890.
An Ordinance to make such provisions as are necessary to enable the Anglo-Portuguese Commercial Treaty to come into force as regards the Colony of Hongkong.
BE it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows:-
1. This Ordinance may be cited as the Anglo-Portu- guese Commercial Treaty Ordinance, 1917.
2. The description "port" or madeira" applied to any wine or other liquor, other than wine the produce of Portugal and the island of Madeira respectively, shall be deemed to be a false trade description within the meaning of the Merchandise Marks Ordinance, 1890, and that Ordinance shall have effect accordingly:
Provided that it shall be a good defence to any pro- ceedings under that Ordinance in respect of such a des- cription as aforesaid if it is proved-
(a) that the wine or other liquor to which the description is applied is intended solely for exportation from the Colony; or
(6) in the case of any wine or other liquor sold or exposed for or kept in possession for sale within twelve months after the passing of this Ordinance, that the description applied thereto was lawfully so applied before the passing of this Ordinance.
Objects and Reasons.
It is proposed that this Colony shall signify its adherence to the recent Anglo-Portuguese Commercial Treaty, and Article 6 of that treaty requires adherents to restrict the use of the terms port and madeira to wine which is the produce of Portugal and Madeira respectively.
This bill, which is founded on the English Act, pro- vides for the necessary legislation. The Act and treaty were published in the Gazette of the 20th February, 1915.

An Ordinance to make provisions for the better protection of forests, forest reserves and plantations from fire.
Be it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows
1. This Ordinance may be cited as the Forest Fires Prevention Ordinance, 1917.
2. In this Ordinance :-
"Forest" means any area of Crown land thickly
covered with self-grown trees.
