(2.) The person serving the writ shall, within three days at most after such service, indorse on the writ the day of the month and week of the service thereof, otherwise the plaintiff shall not be at liberty, in case of non-appear- ance, to proceed by default; and every affidavit of service of the writ shall mention the day ou which the indorsement was made. This sub- section shall apply to substituted as well as other service.
(3.) The writ shall, within eight days after the service thereof, or, in the case of a writ for service, or whereof notice in lien of service is to be given, out of the jurisdiction, within sneh time as the Court may have ordered, be re- turned into the Registry and filed therein.” 9. Section 46 of the Principal Code is hereby repealed and the following section is substituted instead thereof :-

11. Section 709 of the Principal Code is hereby repealed and the following section is substituted instead thereof :-
