ORDINANCE No. 40 of 1909. (TRADE MARKS).

Prohibition of Red

Cross, etc.,

on trade marks.

With reference to the Geneva Conventions Acts, 1911 and 1937, and Orders of His Majesty in Council of 23rd October, 1917, and 21st December, 1937, respectively, the Governor in Council, by virtue and in exercise of the powers conferred on him by section 56 of the Trade Marks Ordin- ance, 1909, hereby rescinds rule 14A of the Trade Marks Rules made under the said Ordinance, under the heading Registrable Trade Marks on pages 363 and 364 of the Regulations of Hong Kong, 1844-1925, published in the Gazette of 29th April, 1938, and substitutes the following rule therefor, with effect from and including 29th April, 1938:

14A. Without the authority of the Governor in Council there shall not appear on any trade mark-

(1) the heraldic emblem of the red cross on a white ground formed by reversing the Federal colours of Switzer- land, or the words Red Cross

Geneva Cross"; or

or

(2) any design consisting of a white or silver cross on a red ground, none of the limbs of which extends to the margin of the ground, being the cross comprised in the Arms of the Swiss Confederation; or

(3) any design being a colourable imitation of the heraldic emblem of the red cross on a white ground mentioned in paragraph (1) or any words so nearly resembling the words Red Cross Or Geneva Cross as to be capable of being understood as referring to the said emblem; or

(4) any design being a colourable imitation of the design mentioned in paragraph (2).
