COLONIAL SECRETARY'S DEPARTMENT.

In exercise of the powers conferred on him by the Emer- gency Powers (Defence) Acts, 1939 and 1940, as applied to this Colony by the Emergency Powers (Colonial Defence) Order in Council, 1939, and the Emergency Powers (Colonial Defence) (Amendment) Order in Council, 1910, His Excellency the Governor makes the following regulations

The Employees Protection (Defence) Regulations, 1941.

1. These regulations may be cited as the Employces Protection (Defence) Regulations, 1941.

2. (1) It shall be the duty of the employer of any person who is a member of the Hong Kong Volunteer Defence Corps, the Hong Kong Naval Volunteer Force, or any civil defence corps or service to which the Civil Defence Corps Regulations, 1941, apply, to permit such person to be absent from his employment for such periods as the officer in charge of such corps, force or service may from time to time direct for the purpose of training, practice or actual service, and no deduction shall be made from the pay of any such person for any such period of absence except for actual service, and in that case the deduction shall not exceed the amount paid by the Government for such service.

(2) Any employer who refuses any such leave as afore- said or who, in the opinion of a magistrate, without just cause dismisses from his employment any person who is a member of any such corps, force or service as aforesaid, shall be liable on summary conviction to a fine not exceeding one thousand dollars or to three months' imprisonment, or to both such imprisonment and such fine, and the magistrate may by order require the employer to reinstate such person in his employment.

3. The provisions of the Defence Regulations of the Colony for the time being in force shall apply for the purpose of the enforcement of these regulations, and otherwise in relation thereto, as if any reference in those regulations. included a reference to these regulations.
