ORDINANCE No. 10 of 1899. (MERCHANT SHIPPING).
By virtue and in exercise of the powers conferred by section 39 of the Merchant Shipping Ordinance, 1899, the Governor in Council amends the regulations made under the said Ordinance and contained in Table U at pages 373-382 of Vol. I of the Regulations of Hong Kong (1937 edition) as follows:
1. The following additional regulation numbered 15A is inserted after regulation 15:-
15A. (a) Before obtaining a licence, the owner of any vessel which is fitted with mechanical means of propulsion must produce to the Harbour Master a certificate from the Principal Surveyor of Ships stating that an inspection of the machinery installation (including fuel storage tanks and piping) and equipment provided for the prevention and extinction of fire has been made, and that he is satisfied there is no undue risk of fire or explosion, and that the machinery will be in charge of a person who is in possession of the appropriate certificate issued under Regulation 20 of Table E.
(b) In every vessel equipped with mechanical means of propulsion there must be provided to take charge of the machinery a person who is in possession of the appropriate certificate issued under Regulation 20 of Table E.
(c) No passengers shall be carried in vessels which are equipped with propelling machinery and licensed under this Regulation.
(d) The following particulars shall be entered in the licence book :-
Type of engines, number of propellers, type or grade of fuel, maximum amount of fuel allowed to be carried and number and type of fire appliances to be kept on board.
2. Regulation 16 is rescinded and the following is sub- stituted therefor :-
16. The licence of a vessel shall be liable to be cancelled or suspended at any time by the Harbour Master on the report of the Principal Surveyor of Ships that in his opinion any steam boiler, propelling or other machinery, fuel storage with which the vessel is fitted or equipped, are not fit for service or, if a vessel is used without having in charge of the machinery a person who has the appropriate certificate issued under Regulation 20 of Table E or, if the maximum quantity of fuel authorized by the licence to be kept is exceeded or, if the number of fire appliances prescribed by the licence are not kept on the vessel or, if these fire appliances are not kept in a sound condition.
