In exercise of the powers conferred on him by the Emer- gency Powers (Defence) Acts, 1939 and 1940, as applied to this Colony by the Emergency Powers (Colonial Defence) Order in Council, 1939, and the Emergency Powers (Colonial Defence) (Amendment) Order in Council, 1940, His Excellency the Governor makes the following regulations-

The One-cent Currency Returns Regulations,

1941.

Returns of one-cent

currency and by whom to be made.

1. These regulations may be cited as the One-cent Currency Returns Regulations, 1941.

2. In these regulations---

Hong Kong copper coin" includes any coin of copper or mixed metal (not being a gold or silver or cupro-nickel or nickel coin) lawfully current by virtue of any proclamation or otherwise in this Colony;

"person

includes a firm and, in relation to a firm required to make a return under these regulations, means the managing partner of that firm.

3.-(1) Every person who is a person, or a member of a class of persons, specified in the First Schedule shall, both on Monday, the first day of September, 1941, and also there- after once in every week before noon on Thursday, or if Thursday is a general holiday, before noon on the next day which is not a general holiday, deliver or cause to be delivered to the Accountant-General a return in the form in the Second Schedule of the particulars therein specified relating to any Hong Kong copper coins or Hong Kong one-cent notes in the possession, custody or control of such person at the close of his business on or for the day immediately preceding the day on which the return is due.

(2) Every person who, not being a person or a member of a class of persons specified in the First Schedule, either at the close of his business on or for the day on which these regulations come into force or at the close of his business on or for any Wednesday thereafter, has possession, custody or control of Hong Kong one-cent currency, whether in Hong Kong copper coins or Hong Kong one-cent notes or in both such coins and such notes, to the total value of one hundred dollars or more shall before noon on the following day, or if that day is a general holiday, before noon on the next day which is not a general holiday, deliver or cause to be delivered to the Accountant-General a return in the form in the Second Schedule of the particulars therein specified relating to such coins and notes.

(3) If any copper coins or one-cent notes are in the joint possession, custody or control of more than one person, it shall be sufficient if one of such persons duly delivers a return of the particulars required in respect of the coins in accord- ance with the provisions of paragraph (1) or (2) as the case may be, but without prejudice to the liability of all or any

of such persons for a breach of any of those provisions.
