An Ordinance to amend the Merchant Shipping (No. 2) Amendment Ordinance, 1934, and the Merchant Shipping Ordinance, 1899 as amended by the Merchant Shipping Amendment Ordinance, 1935.

BE it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Merchant Shipping Short title. Amendment Ordinance, 1937.

2. Section 5 of the Merchant Shipping (No. 2) Amend- Amendment ment Ordinance, 1934, is amended by the repeal of sub-section of Ordinance (2) of the new provision of section 41 of the Merchant Ship- 1934, s. 5. ping Ordinance, 1899, which it enacted.

3. Paragraph (aa) of section 2 of the Merchant Shipping Repeal Ordinance, 1899, enacted by section 2 (i) of the Merchant No. 10 of Shipping Amendment Ordinance, 1935, is repealed.

4. This Ordinance shall not come into operation unless and until the Governor notifies by Proclamation His Majesty's clause. pleasure thereon; and thereafter it shall come into operation upon such day as the Governor shall notify by the same or any other Proclamation,

Objects and Reasons.

1. Section 5 of the Merchant Shipping (No. 2) Amend- ment Ordinance, 1934 (Ordinance No. 25 1934) repealed the first three sub-sections of section 41 of the principal Ordinance (No. 10 of 1899) and substituted three new sub-sections. The new sub-section (2) provided that where by or under any of the Merchant Shipping Acts functions are required to be per- formed by the Governor, such functions may be performed by the Governor or by any public officer nominated for the purpose by him.

2. Ordinance No. 25 of 1934, is not yet in force, as by section 7 thereof its operation is suspended pending the notification of His Majesty's pleasure thereon.
