Applicants in respect of butter, cheese, powder- ed milk, dry dessicated milk, dry skimmed milk, malted milk, and milk in any other form and other dairy products in Class 42 since 1899.
The said Trade Mark is associated with Trade Mark No. 135 of 1921, and that the Registration of this trade mark shall give no right to the exclusive use of the device of a label with the upper part red and the lower part white, and to the exclusive use of all the words appearing on the mark with the exception of the word "Carnation ".
Registration of this trade mark is limited to: colours, as regards the carnation and the parti-coloured background to the colours red and white and as regards the stems and leaves of the carnations to the colour green as shown in the representation on the form of application for registration.
