An Ordinance to amend the Deportation (British Subjects)
Ordinance, 1936.
BE it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:
1. This Ordinance may be cited as the Deportation (British Subjects) Amendment Ordinance, 1937.
2. Section 2 of the Deportation (British Subjects) Ordin- ance, 1936, is amended-
(i) in sub-section (2) (a) by the insertion after the word "Colony" of the words or of parents who at the time of his or her birth were ordinarily resident in the Colony";
(ii) in the first paragraph of sub-section (3) by the deletion of the words "since the date of his last arrival therein" and by the substitution therefor of the words ", immediately preceding the service of the notice or the charge,";
(iii) in sub-section (3) (b) by the deletion of the words "seven years" and by the substitution therefor of the words "two years".
3. Sub-section (1) of Section 9 of the Deportation (British Subjects) Ordinance, 1936, is amended by the insertion after 1936, s. 9 (1). the words "person charged" of the words "together with a summary of the findings of fact and conclusions of law as stated in the report made under section 6 (2) of this Ordin- ance".
Objects and Reusons.
1. The amendments to be made in the principal Ordinance by this Bill have been suggested by the Secretary of State with a view to bringing that Ordinance into closer conformity with a Model Bill attached to the Report, dated the 12th September, 1933, of a Departmental Committee of the Colonial Office appointed by the Secretary of State.
2. Section 2 (2) of the principal Ordinance set out five classes of British subjects who were to be deemed to belong to the Colony. Class (a) was confined to British subjects
