person otherwise than on the ground floor of a building : such ground floor shall be of fire-proof or fire-resisting materials throughout and any stairs, staircase, stair lining, or other communication or passage-ways through such ground floor, whether to other floors, or to portions or premises above or adjoining or alongside the same, shall be of fire-proof or fire-resisting materials throughout.

(4) Paragraph (g) of rule 5 is rescinded.

(5) Rule 6 is rescinded and the following rule is substituted therefor :-

6. Subject to the proviso contained in this rule, no quantity of fireworks in excess of 400 lbs. in weight shall be stored by any person elsewhere than in a magazine which

(a) is substantially built of brick, stone or concrete, or iron covered with fire resisting material; and (b) has no exposed iron or steel in the structure

thereof; and

(c) is detached from any dwelling, or is set back at a distance of not less than 50 feet from any street, passage or other public place.

Provided that, with the written permission of the Inspector General of Police, which permission may be subject to conditions imposed by him and may be given, withheld or withdrawn in his discretion, a one-storey godown, constructed entirely of fire resisting materials and detached from residential property, may be used in substitution for a magazine as aforesaid.

Except as may be necessary in the proper use of any such magazine or permitted godown the same shall be kept securely locked.

The requirements set forth in paragraphs (a), (b), (c) and (f) of rule 5 shall apply to and be complied with in respect to any such magazine or permitted godown.
