made in Copyright Register.

Courts and Judges by persons aggrieved by entries in the said book, and the expunging and varying such entries, shall apply mutatis mutandis to the Copyright Register, and to the entries and assignments of copyright and pro- prietorship therein under this Ordinance, in such and the samo manuer as if such enactments were herein expressly enacted in relation thereto, save and except that the forms of entry prescribed by the said Act may be varied to meet the circumstances of the case, and that the sum to be demanded by the officer so deputed as aforesaid for making any entry required by this Ordinance shall be fifty cents and for searches fifty cents for every entry searched or inspected and for copies certified under his hand and seal two dollars.

4. The owner of any copyright in any book or dramatic piece found published in this Colony or any person who becomes entitled to any copyright in such book or dramatic piece by virtue of any assignment or transmission or to any interest therein by licence may obtain registration of his right or interest in the Copyright Register.

5. No notice of any trust expressed, implied or con- structive shall be entered in the Copyright Register.

Objects and Reasons,

The object of the Bill is to amend the law of copyright in this Colony. A local register is provided for books and dramatic pieces first published in this Colony. The owner of the copyright of any book first published in this Colony as the law is at present has to register under the Copyright Act 1842 at Stationers Hall before he can enforce his rights against infringers. Under this Ordinance he may register either locally in the Copyright Register or at Stationers Hall.

The provisions of the Copyright (Musical Compositions) Acts 1882 and 1888 which are extended to this Colony prevent unjust use being made of earlier enactments and give the Court a discretion as to the amount of penalties and as to the costs to be awarded in proceedings for penalties for infringement.
