PART IX.
Penalties and Forfeitures.
49. Every omission or neglect to comply with and every Other penal- act done or attempted to be done contrary to the provisions ties. of this Ordinance or of any regulation made thereunder or permit granted or Order-in-Conneil issued thereunder shall be deemed to be an offence against this Ordinance and for every such offence not otherwise specially provided for the offender sball in addition to the forfeiture (if any) of the article seized as hereinafter provided be liable to the following penalties :--
(a.) for every first offence a fine not exceeding five hundred dollars or imprisonment with or with- out hard labour for any period not exceeding six months,
(b.) for every second offence a fine not exceed- ing one thousand dollars or imprisonment with or without hard labour not exceeding twelve months,
(c.) for every subsequent offence a fine not exceed- ing two thousand five hundred dollars or im- prisonment with or without hard labour not exceeding twelve months or to both fine and imprisonment.
51. All intoxicating liquors and denatured spirits in Forfeitures, respect of which any offence may have been committed against this Ordinance or against any regulation made or permit granted thereunder or any breach of the restrictions and conditions subject to or upon which any licence has been granted together with any still utensil or apparatus or any vessel package cart carriage or conveyance in which the same may be found or which may have been used in con- nection with such offence may be seized by any police or revenue officer and all such intoxicating liquors denatured spirits stills utensils apparatus vessels packages carts carriages or conveyances shall be forfeited to the Crown.

52. 53.—(1.) Whenever any person to whom any licence has Licensed been granted under the provisions of the Liquor Licences persous to be Ordinances, 1898-1908, or the New Territories (Regulation) responsible Ordinance, 1899, or this Ordinance, or any keeper of a for acts of King's warehouse or any licensee of a licensed warehouse servants, shall be liable under the provisions of this Ordinance to any Agents and punishment penalty or forfeiture for any act omission or servants to be neglect he shall be liable to the same punishment penalty or forfeiture for every similar act omission or neglect of any agent or servant employed by him in or about his licensed premises or King's or licensed warehouse and every agent or servant employed by him in or about his licensed premises or King's or licensed warehouse shall also be liable to every punishment penalty or forfeiture prescribed for such acts omissions or neglect contrary to the provisions of this Ordinance as fully and effectually as if such agent or servant had been the person to whom such licence had been granted or had been the keeper of such King's or licensed warehouse.
