An Ordinance to amend The Larceny Ordinance,
1865.

Be it enacted by the Governor of Hongkong, with
the advice and consent of the Legislative Council thereof,
as follows:-
1. This Ordinance may be cited as The Larceny Short title. (Amendment)_Ordinance, 1909, and shall be read as
one with The Larceny Ordinance, 1865.
2. Section 62 and 63 the Larceny Ordinance, 1865, Repeal are hereby repealed.
(Sees, 75 and
76 Larceny Act, 1861.)
3. Section 4 of this Ordinance shall be deemed to be Construc-
tion. substituted for sections 62 and 63 of the Larceny Ordinance, 1865, and references in any enactment to those sections shall be construed as references to section 4 of this Ordinance.
4.-(1.) Whosoever :--
(a.) being entrusted, either solely or jointly Fraudulent
misappro- with any other person, with any property, priation of in order that he may retain in safe custody property. or apply, pay or deliver, for any purpose or (Larceny Act. 1901, to any person, the property or any part s. 1.) thereof or any proceeds thereof; or
(7.) having, either solely or jointly with any other person, received any property for or on account of any other person,
fraudulently converts to his own use or benefit, or the use or benefit of any other person, the property or any part thereof or any proceeds thereof, shall be guilty or à misdemeanour, and be liable on conviction to imprison- ment with or without hard labour for any term not exceeding two years.
(2.) Nothing in this section shall apply to or effect any trustee on any express trust created by a deed of will, or any mortgagee of any property, real or personal, in respect of any act done by the trustee or mortgagee in relation to the property comprised in or affected by any such trust or mortgage,
