Unless otherwise agreed the licensee shall provide and place in service fit and ready for use on and after the 1st day of October, 1927, not less than 9 ferry vessels, of which 2 shall be ferry vessels in reserve, of not less than 90 feet overall measurement with suitable beam not less than 16 feet and a, speed of not less than 10 knots, fitted with a navigation bridge and water-tight bulkheads and in all respects, to the satisfaction of the Harbour Master and painted in such colours as he may direct and duly surveyed and licensed under the Merchant Shipping Ordinances, 1899 to 1917. The above mentioned number, overall measurement and speed of the vessels are not necessarily to be adhered to in making out tenders which may contain a list of suitable ferry vessels of different number, overall measurement and speed.
The Kowloon Dock Service which runs between Queen's Pier and the Docks at Hung Hom not being a service run for payment or reward shall not be interfered with or hampered in any way by the licensee: the carrying on of such service shall not be deemed to infringe or affect the rights of the licensee or to give rise to any clain what- soever by him.
Every tenderer must submit with his tender a list of maximum charges for the carriage of animals, birds, goods, merchandise, minerals and parcels: but the settlement of those charges and their inclusion in the licence is for the information of the public. only and implies no monopoly to the licensee in the matter of the carriage of goods of any description.
Every tenderer must deposit with the Colonial Treasurer the sum of $1,000 as security and shall forward the Treasurer's receipt therefor to the Colonial Secretary with his tender which amout will be returned to the unsuccessful tenderer in accordance with the regulations.
The successful tender is required by the regulations to furnish such security as may be required by the Harbour Master in a sum equal to three months rent for the establishment of the ferry or ferries on the proper date and for its efficient maintenance during the term of the lience and for the compliance by the licensee with all the condi- tions of his licence and with the regulations for the time being in force relating to such ferry or ferries. Such security shall be furnished within fourteen days after the posting to the successful tenderer of a notice of acceptance of his tender. The deposit will not be returned until such security shall have been furnished.
Forms of tender may be obtained on application to the Colonial Secretary's Office where copies of the regulations may be seen.
The Government does not bind itself to accept the highest or any tender.
