An Ordinance to amend the Magistrates Ordi-

nance, 1890.

BE it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:--

1. This Ordinance may be cited as the Magistrates Amendment Ordinance, 1927.

2. Section 8 of the Magistrates Ordinance, 1890, as amended by section 3 of the Magistrates Amend- ment Ordinance, 1926, is further amended by the insertion of the words "the Deputy Harbour Master No. 2 of 1926. immediately after the words "Harbour Master".

3. Section 10 (2) of the Magistrates Ordinance, No. 3 of 1890, 1890, is amended by the addition of the following

words at the end thereof :—

"

and that it shall be lawful for a magistrate in any such event to hear and determine the case in all respects as if the defendant had appeared in answer to a summons".

4. Section 11. (1) of the Magistrates Ordinance, No. 3 of 1890, 1890, is amended by the repeal of the words "

on oath being made before him substantiating the matter of the complaint or information to his satisfaction", in the seventh, eighth and ninth lines thereof.

5. Section 31 of the Magistrates Ordinance, 1890, is amended as follows:-

(a) Paragraph (1) is amended by the addition of

the following words at the end thereof :- "he may order the defendant to enter into a recognizance with or without sureties, to be of good behaviour or to keep the peace, in a sum not greater than two hundred dollars and for a term not to exceed twelve months; or ".

(b) Paragraph (2) is amended by the insertion of the words "or to keep the peace " imme- diately after the word "behaviour" in the fourth line thereof.

(c) Paragraph (2) is also amended by the addition

of the following words at the end thereof; “Provided that the security required shall not~~ exceed two hundred dollars and the time during which the defendant may be called upon to appear for sentence or during which he is to be of good behaviour or is to keep the

peace shall not exceed twelve months."
