EXECUTIVE COUNCIL.

No. 554.

Rule made by the Governor in Council under section 18 of the Prisons Ordinance, 1899, Ordinance No. 4 of 1899, on the 28th day of September, 1927.

The rules made by the Governor in Council under section 18 of the Prisons Ordi- nance, 1899, and published on pages 181 to 257 of the Regulations of Hong Kong, 1844-1925, amended as appears in Government Notifications Nos. 409 and 506 of 1926, are hereby further amended by the rescission of rule 189-on page 216-and the substi- tution of the following rule therefor :-

"189.-Rules Nos. 165 to 188 (both inclusive) of these rules, relating to prisoners

awaiting trial, shall apply to the following prisoners :--

(

(1) prisoners committed for trial for any indictable offence; (2) prisoners detained pending the preliminary hearing before a

magistrate of a charge against them of an indictable offence; (3) prisoners detained pending the hearing of an information or

complaint against them;

(4) prisoners detained in any proceeding under the Extradition Ordinance, 1875, and the Extradition Acts, 1870 and 1873, whether pending the extradition proceedings or awaiting their surrender;

(5) prisoners detained in any proceedings under the Chinese Extra- dition Ordinance, 1889, whether pending the extradition pro- ceedings or awaiting their surrender ;

(6) prisoners who have been granted a review under the provisions

of section 96 of the Magistrates Ordinance, 1890;

(7) prisoners who have applied to a magistrate for a review under section 96 of the Magistrates Ordinance, 1890, while the appli- cation is pending ;

(8) prisoners who have applied to a magistrate to state a case or for leave to appeal under Part VI of the Magistrates Ordinance, 1890, while the application is pending;

(9) prisoners who have had delivered to them a case stated or a certificate of leave to appeal under Part VI of the Magistrates Ordinance, 1890, while the appeal is pending;.

(10) prisoners detained under the Deportation Ordinance, 1917; and (11) prisoners who by any enactment in force in the Colony are declared to be, or are to be treated as, prisoners awaiting trial.

No. 555. It is hereby notified that Ilis Excellency the Governor in Council has given directions for the rescission of the Order of the 25th August, 1927, published in the Gazette of the 2nd September, 1927, as Government Notification No. 494, declaring Macassar to be a place at which an infectious or contagious disease prevailed, and the same is hereby rescinded.
