2. Alan Donald's reply (his letter of 8 July to Macdonald copied to Peter Corley) mentioned that we were consulting our legal advisers over whether a letter on the lines of DOI's draft would be consistent with our Community obligations. Our legal advisers's view is that we might well find ourselves in trouble on legal grounds if the DOI draft were to issue and subsequently come into the hands of the Commission. An indication that we 'support' commercial arrangements to restrict imports might be regarded as an attempt to encourage, if not impose, a VRA.
3. Your draft is, on the other hand, much less open to criticism from the Community law angle, since it only makes a comment that the figure seems not unreasonable. I am not entirely happy with even this measure of support for Thorn EMI, but if this will satisfy the DOI I think it
I is better than appearing completely unsympathetic towards them. should, however, prefer it if the phrase 'to the government' were omitted. I very much agree with Derek March's comments in his letter of 12 July, in particular the second sentence of his paragraph 3.
