Home Secretary's letter of 19 September to Lord Carrington.

I am grateful to MVD whose forceful and timely representations helped to achieve the modification of the descent provisions recorded in the Home Secretary's letter.

The background of the extension of the Crown Servant, provision to employees of EC institutions is given in Mr Whitelaw's letter and in the attached draft submission and reply. From the point of view of consistency in the new nationality legislation the amendment is deplorable, but in the parliamentary circumstances we have no alternative but to accept it.

The Home Office have suggested (not in Mr Whitelaw's letter) that other international organisations could have the privilege extended to them under Clause 2(3) of the Bill which empowers the Home Secretary to 'designate any description of service which he considers to be closely associated with the activities outside the United Kingdom of HMG in the United Kingdom'. This clause was designed to provide for a very few categories such as the British Council whose work abroad is demonstrably to that of the Diplomatic Service. Ministers have gone on record to that effect, and in any case it could be difficult to extend this discretion to international organisations since their employees would have a first loyalty to the organisation and would not necessarily be closely associated with the policies of HMG.
