Mr Clift asked me to contact NTD to arrange a reference to HMOCS and the British Council in the draft minute to Mr Adams. Mr Howells explained that the Home Office were anxious to have the letter last night; it was consequently issued last night. The minute is also on its way to Mr Adams. Mr Howells suggested that send a minute on the lines of the attached draft to ensure that our position is on record.

2. Mr Clift asked me to ensure that we received a copy of the written decision by Ministers to include HMOCS under the British by Birth' provisions. Mr Howells explained that Ministers have it in mind to include HMOCS in the designated service category; but as yet no formal decision has been taken. The nearest thing as a reference to HMOCS et al by Mr Raison in the House of Commons Committee when the Minister explained that the Government had

not yet made up its mind as to the designated categories, but that the British Council HMOCS and certain Governors sprang to mind. This is the document which we shall be receiving in due course. The designated service will be incorporated into the Order in Council relating to the Nationality Act once the Act has received Royal Assent. NTD are however not in any doubt that HMOCS will be included, but of course until the Order in Council has been drafted and approved there is always some element of uncertainty.
