THE WHALING INDUSTRY (SPERM WHALES) ORDER, 1937

1937 No. 628

At the Court at Buckingham Palace, the 1st day of July, 1937.

PRESENT,

The King's Most Excellent Majesty in Council. Whereas by Section 1 of the Whaling Industry (Regulation) Act, 1934 (hereinafter referred to as “the Act "), it is enacted that if for the purpose of enabling effect to be given to any convention

whalebone whales or

baleen whales other than relating to whales which is signed on behalf of His Majesty after the commence- ment of the Act it appears to His Majesty to be necessary so to do, His Majesty may by Order in Council direct that subject to such exceptions adaptations or modifications (if any) as may be specified in the Order the provisions of the Act shall apply in relation to those other whales or to such descriptions thereof as may be so specified:

And whereas a Convention for the Regulation of Whaling was signed in London on the 8th day of June, 1937, some of the provisions of which apply to Sperm Whales:

And whereas for the purpose of enabling effect to be given to the said Convention it appears to His Majesty to be necessary that the provisions of the Act should apply with modifications to Sperm Whales as defined in Section 2 of this Order:

Now, therefore, His Majesty, by and with the advice of His Privy Council, is pleased to direct, and it is hereby directed, as follows:--

1. The provisions of the Act shall apply to Sperm Whales as defined in Section 2 of this Order:

Provided that nothing in Section 3 of the Act shall be deemed to prohibit the killing or taking, or attempting to kill or to take, a Sperm Whale, which is neither an immature whale nor a female whale which is accompanied by a calf.

2. In this Order the expression Sperm Whales means whales known by the name of Sperm Whales, Spermacet Whales, Cachalot or Pot Whales.
