1. I have discussed Stephen Wright's letter of 15 March (attached) with Mr Ricketts.

We agreed that theology was having too great a role in this issue. The Commission was being excessively ambitious, while Legal Advisers and Hong Kong were showing insufficient flexibility. Mr Ricketts argued that we should not put pressure on Hong Kong. It was for them to find a solution, given that they had the interest in seeing the EC office established.

3. I recalled that we had argued for three years in favour of such an office. It was now time for a sensible accommodation. We had no wish to dictate to Hong Kong, but a more reasonable position would be to offer some concessions, but in a form which did not necessitate specific legislation in the Colony. I also said that we should accept that no commitments could now be given or sought for the Commission on the post-1997 arrangements. Those would have to be tackled in due course.

I urged Mr Ricketts, and he agreed, that HKD would produce a short note setting out what the Commission was seeking, what was available to Consulates in Hong Kong, and then what might be given informally to the Commission through administrative decisions of the Hong Kong Government. That should provide the basis for a sensible accommodation. Please pursue this with HKD, against the deadline of the Governor's visit to Brussels at the end of the month.
