Thank you for your fax letter of 26 March 1993.
Looking at my file, I have a suspicion that the shorthand list Leferred to in paragraph 2 of my 19 marcn letter was not put on the fax machine with the letter. If that is so, my letter would not have been of much help and I apologise for the omission. The list of consular privileges and immunities is (definitely) now attached.
As you know, we have already given the EC a list of the privileges and immunities which would be available to them under Cap 190 (Cherry Ling's letter to Borrell of 2 January 1993). We now await Simon Nuttall's promised informal note (UKREP telegram no. 267, paragraph 4) setting out the EC's precise requirements for privileges and immunities, and we await the EC's response to our telegram no. 319.
Meanwhile, we are looking to see how much further we could go beyond Cap 190 by means of administrative action and informal agreement. For this, we are currently seeking advice from a number of Hong Kong Government Departments because some potentially tricky legal questions are involved.
There would be no objection on our part to giving Brussels in your
end of March note the list of privileges and immunities afforded to the consular posts in Hong Kong. But I think we should take care not to give the EC the impression that we could bridge all the gaps between Cap 190 and the VCCR by administrative action. This may not be possible.
