FUTURE CONSULATE GENERAL IN HONG KONG: PRIVATE TREATY GRANT

Mr Morris has passed on to me your thoughts for inclusion in our preferred version of Special Condition 14 of the Private Treaty Grant (PTG).

2. You will now have seen (my minute to you of 11 January) that I have already amended paragraph (b) of SC 14 in the sense you seek. That is to say that the reference in the first sentence is to "alternative premises of similar standard".

Subject to Miss Brooks' views, I agree with you that we should amend the reference to the period of notice in the fourth line of print from "12 calendar months" to "36 calendar months". You also request that re-taking possession (second line of print) should apply to "all" rather than to "all or any part of" the lot, in line with suggestions from BTC's lawyers. At the Steering Committee meeting on 6 January, Miss Brooks explained her reasons for preferring "all or any part of". I see the argument for both wordings. I suggest that we go for "all" (and not "all or any part of"), on the understanding that, if we look like getting HKG to agree to other points of substance and need to compromise, we might be flexible on this (the wording in the Hong Kong draft is "all or any part"). Does this sound reasonable?
