The Conseil d'État in its litigation composition

Upon the report of the 2nd sub-section of the litigation section,

Having regard to the summary request and the additional observations filed on 12 November 1992 and 11 March 1993 with the secretariat of the litigation section of the Conseil d'État, presented on behalf of the United Kingdom of Great Britain and Northern Ireland and the Governor of the Crown Colony of Hong-Kong: the plaintiffs request the Conseil d'État to cancel the implicit decision of refusal resulting from the Garde des Sceaux, Minister of Justice and the President of the Republic not answering for more than four months their gracious request of 19 May 1992 directed against the decision refusing the request for extradition of Mr Bin Saniman contained in the letter addressed on 20 March 1992 by the Minister of Foreign Affairs to the Embassy of Great Britain in France;

Having regard to the other elements of the file;

Having regard to the Franco-British Extradition Treaty of 14 August 1876 as amended by the Treaty of 13 February 1896, the Treaty of 17 October 1908 and the exchange of letters of 16 February 1978:
