Appeal lodged by the United Kingdom in its own name and as international representative of the Crown Colony of Hong Kong against the implicit decision. of refusal of its request of 19th May 1992 for the cancellation of the decision of 20th March 1992 notifying the refusal to extradite to Hong Kong Mr Rais Bin Saniman, and against such latter decision.

By a summary recourse of 12th November 1992, the United Kingdom, by the intermediary of SCP H Masse-Dessen G Thouvenin B Georges, advocates in the Conseil d'Etat, submitted to the Conseil:

the implicit decision of refusal, resulting from the silence kept the administration in respect of its request dated 19th May 1992, for the cancellation of a decision, notified by a note verbale of 20th March 1992 whereby the extradition of Mr Rais Bin Saniman to Hong Kong was refused,

such latter decision.

The full pleadings of the claimant and the observations for the defence by Mr Rais Bin Saniman having been lodged respectively on 12th March and 8th April 1993, the new grounds raised therein will be examined below; the extradition procedure has been discussed in the preceding observations of the Minister of Justice, which the Conseil may please refer to.
