The agreement between the UK and Austria on the abolition of visas is set out in a 1968 Exchange of Notes (EON). This referred to British subjects, citizen of the United Kingdom, and Colonies and British subject, citizen of the United Kingdom, Islands and Colonies. It was
on the basis of these terms that BDTCs were given visa-free access to Austria. The original agreement was amended on three occasions, in 1969, 1970 and 1971.
3. We have consulted our Legal Advisers on the suggestion put forward by the Austrian Consul General (para 3 of your first TUR) that the BN (0) problem could be solved by an exchange of Letters. They say that as the original agreement and its amendments were set out in an EON the most obvious format for a further amendment to the agreement would also be an EON.
The difference between an EON and an exchange of letters is merely one of form and the important point is the language used in the document. As with the original agreement and its subsequent amendments this should be legally binding language.
Before drafting an EON on BN (0)s we propose to approach the Austrians first to ask them formally whether they would be prepared to negotiate a further amendment to the 1968 EoN. We intend to do this in Vienna by Diplomatic Note. In the meantime we are approaching the Home Office on the (returnability problem (para 7 of your first TUR) which, although not mentioned by the Austrian Consul General, (is) likely to be raised by the Austrian Government during the negotiations.
