LORD BONHAM--CARTER'S PRIVATE PEERS BILL : BRITISH NATIONALITY

(HONG KONG)

I attach a copy of the Bill and extracts from today's Lords Minutes and Hansard which show that Lord Bonham-Carter introduced his British Nationality (Hong Kong) Bill, to provide for the acquisition of British Citizenship by certain of the British nationals of Hong Kong. I understand that it is likely to receive its Second Reading on Monday 13 December Lord Felleis is currently expected to speak for the Government during the debate.

The Home Secretary has requested that the letter to the Business Managers on the Parliamentary handling of Private Peers Bills should normally be signed by the Junior Minister with the appropriate departmental responsibility. However, officials should be aware that the Home Secretary would like Bills which are likely to have a significant political impact to be drawn to his attention.

On this basis assuming that the Bill is not welcome to the Government, but that

hat it socd not be kloaked until ik maaches the House of Commons, a short letter recording this view, and the reasons for it, should be sent from the appropriate Junior Minister to the Chairman of Legislation Committee, (Tony Newton) copied to other members of LG, any other Minister with an interest, First Parliamentary Counsel and the Secretaries to LG Committee. If on the other hand we propose to support or be neutral towards the Bill it would be necessary to obtain policy clearance from EDH Committee. could be achieved by means of a letter from the Minister concerned to the Lord Privy Seal (Lord Wakeham). If, however, EDH have previously given policy clearance for the handling of Bills on this subject, a letter to Tony Newton, setting out this position, would suffice.
