PARLIAMENTARY QUESTION ON NATIONALITY

1.

Mr Nigel Waterson MP has tabled the following parliamentary question (PQ) for written answer by the Secretary of State:

To ask the Secretary of State what discussions he has had with the People's Republic of China about the freedom of movement of Hong Kong residents who are holders of BN (0) passports after 1997; and if he will make a statement.

2. We have seen your telno 1836. While we do not suppose that Tian Qiyu's remarks prompted the PQ, the question serves to demonstrate the sensitivity of the freedom of travel issue pointed up by your TUR. (We will be replying separately to that telegram). Subject to your views, we intend to answer the PQ as simply as possible, as follows:

The terms of Memoranda exchanged by the UK and Chinese sides and associated with the Joint Declaration enable Hong Kong residents with British National (Overseas) Passports (BNO) to use these passports as travel documents after 1997. Under the Joint Declaration and the Basic Law all Hong Kong residents, including BNO passport holders, will enjoy freedom of travel.
