HONG KONG GOVERNMENT'S PROPOSAL
The Governor has proposed to the Legislative Council that an appeal panel be set up to advise him on late applications for DM(0) paceporte which the Director of Immigration has refused to accept. Details of the proposal are as follows

The Panel will be administrative in nature. The final
decision on all cases will be made by the Governor.
The Panel will be made up of a majority of Legislative Council members and the Secretary for Security or his
representative.
The Fanel will look at all late applications rejected by the Director of Immigration, including those submitted overseas,
PRESENT POSITION
The Legislative Council has preliminarily indicated that the idea of an appeal panel is acceptable in principle but is still considering the Hong Kong Government's proposal regarding composition of the panel. The Home Committee decided on 9th July, in view of varying views, to canvas all LegCo Members' views individually before returning to the Administration.
The Administration is prepared to discuss the details further with the Legislative Council
if the latter so wishes. However some LegCo Members' insistence that there should be no official membership and that the Governor should guarantee in advance to accept all Panel recommendations will not be accepted.
In any
case the Pancl needs to be established by end of October, the first cut-off date.
