Your second question asked about the machinery and criteria for dealing with late applications. The procedure will be that those who miss the deadlines (including those who are overseas) will be able to submit their applications to the Director of Immigration in Hong Kong along with a letter and supporting evidence outlining the reason/s for it. Every case will be considered on its merits. It is impossible to give an exhaustive list but circumstances which will be looked at sympathetically will include those where an applicant could not meet the deadline because of health problems, he was overseas and unable to make an application to one of our posts (for instance because of remoteness) or he was in prison.
Cases which the Director refuses will go automatically to the appeal panel which the Governor is setting up. Composition is still being discussed but the panel is likely to consist of two members of the Legislative Council and the Secretary for Security. or his representative. The panel will advise the Governor, who will make the final decision.
