This is to confirm that, at your request, I just spoke at his home to the Home Office officer responsible for the above (Chris Kelly) on the scenario/timetable he sent us and we faxed you earlier

today.

He confirmed the Order was for Affirmative Resolution in both Houses. He said that the Committee on Statutory Instruments only cleared effectively whether the Order was drafted OK, within vires etc. It would then be for the Whips/Business Managers in the usual way to decide whether the Order needed the full treatment on the floor of the house, or "out of the way" in a committee. This in turn would depend on a political judgment as to its importance/controversy, as well as rival demands for House time.

Chris Kelly's view was that it is still touch and go on this. It depends effectively, I imagine, on whether the opposition are convinced enough by the LegCo lobby or whether they spot this is a non-issue which it would not be worth their while being too involved with.

Chris Kelly would be prepared to answer any other Ministerial questions, although he is at home tomorrow (0704578200).
