This is to seek your expert advice as to how persons who are holding both BC and Hong Kong BDTC statuses but who are holding a BC passport will be able to retain both the BC and BN (0) statuses on or after 1 July 1997 if they want to do so.

UK Memorandum associated with the

the Joint Declaration on the future of Hong Kong and the Hong Kong Act 1985 provide that BDTCs by virtue of a connection with Hong Kong will cease to be BDTCS on 1 July 1997, but they are entitled, before that date (or by the end of 1997 if born on or before 30 June in that year), to acquire a new form of British nationality known as British National (Overseas) and to hold or be included in a passport appropriate to that status. JD 227 (copied at Annex A) also states clearly that the passport has to be issued before 1 July 1997. Therefore, a person must be registered as a BX(0) and hold a BN(0) passport in order to retain BX(0) status on or after 1 July 1997.
