Problem

1. The Home Secretary has written to the Secretary of State and to other OPD (K) colleagues to seek agreement to proceed with the drafting of two Orders in Council relating to British Nationality in Hong Kong. The two are to be presented

together to Parliament, probably in May.

Recommendation

2.

I recommend that the Secretary of State should write to

the Home Secretary endorsing his proposals. I submit a draft

reply, which our Departmental Legal Adviser has seen. This

will need to issue by 19 February to meet the Home Secretary's

deadline.

Background

3. The Home Secretary's proposals reflect liaison with the

Hong Kong Government and FCO officials. ExCo have endorsed them. Both Orders in Council are necessary for British

sub.orders.NAT
