You will recall that we raised the above case with

you on 9 January 1992. On 17 January 1992 you confirmed that the above-named was detained in Shenzhen on 27 May 1990 for

spying for Taiwan. Subsequently on 5 June 1990 the Hainan Procuratorate ordered that he be formally arrested but that

The case had not yet gone to court. Since then, we have not

been informed of further details.

Recently the above-named's wife, Madam Lau Ah-kuk has again written to us requesting our assistance for the release of her husband. She was particularly anxious to learn the whereabouts of her husband and requested that he be brought to

fair trial as soon as possible.

Hong Kong Government would be grateful to be updated on this case. We understand that the legal limit for detaining a person without trial in China is three months, after which the detainee must be charged, except in exceptional circumstances. We would like to know whether Mr. Tsim is still being held in Hainan and whether he has been charged by the Hainan authorities if so, with what? If not, then the above-named should be brought to fair trial as scon

as possible.
