Legal Advisers confirm that we have no formal locus to raise such cases with the Chinese and have said that the Chinese are in any case not bound to give us any information as they are not a party to the International Covenant on Civil and Political Rights.
2.
Apart from the Prime Minister's intervention (during his visit to Peking in September 1991) over the four Hong Kong political prisoners, we have no record of a British minister formally taking up any Hong Kong consular cases directly with the Chinese authorities in recent years. However as you are aware (our telno 678) Mr Goodlad was able to take the opportunity of a visit by the Chinese Charge on other business on 16 July to raise informally with him Chong's case.
In para 3 of your telno 995 you mentioned that you would approach Zhao about this case in the margins of the latest round of talks. Grateful to know if you were able to do this and what was the result.
