YOUR TELNO 249: GOVERNOR'S DECLARATION OF INTEREST
1. Ministers have no objection to the Governor making a Declaration of Interest in ExCo.

As far as we can establish, no other Governor of a dependent territory makes such a Declaration. To avoid setting a precedent which others might be asked to follow, we would prefer that, if the Governor signs the form, it be made clear that he has chosen to do so voluntarily. We would also prefer that the form itself be kept confidential. (We understand that this is already the practice for the forms returned by members of ExCo). This would not prevent you from confirming that the Governor has no declarable interest in Hong Kong.

Our Legal Advisers, while content that there are no legal implications, have pointed out that the purpose of the form is to ensure that ExCo tender impartial advice to the Governor. This is a point you may want to cover in explaining publicly why the Governor has decided to complete the form himself.
