As proceeds from the confiscated assets represent windfall gains, rather than budgeted revenue, members of the public are not expected to react adversely to the proposal to share the assets with bilateral partners on a case-by-case basis.

Subject to Members' approval of the recommendation at paragraph 2, a press release will be issued on the day the subject is discussed by the Finance Committee. A Legislative Council Brief will be issued after we have informed the American side of the decision to share with them the assets confiscated from the LAW Kin-man case on the basis described in paragraph 2(a) and (b) above.
