Thank you for your lelled of 20 July.

Section 10 of Hong Kong's Prevention of Bribery Ordinance requires any civil servant found in possession of wealth disproportionate to his official emoluments to give a satisfactory explanation to the court as to how such wealth came under his control, failing which he shall be guilty of an offence. We have certainly found this Section useful in dealing with corrupt civil servants, particularly when corrupt payments could not be directly related to à corrupt act. I attach the full text of Section 10. There are no similar provisions for non civil servants.

Since the ICAC came into being in 1974, we have had a total of 48 Section 10 prosecutions.
