of live animals and deck cargo, the seaworthiness of vessels, and the application of Articles IV and X of the Rules, similar to the existing provisions in the 1980 and 1982 Orders. The 1980 and 1932 Orders will be repealed, with any necessary savings and consequential amendments.

The localising Bill proposed by the British side will, as required by the Rules, have extraterritorial effect in that the Rules will apply to and in connection with the carriage of goods by sea anywhere in the world, in ships wherever registered, if the goods are shipped in Hong Kong.

With regard to the transfer of functions from an authority in the United Kingdom to an authority in Hong Kong, the Chinese side will note that under the 1980 Orders powers to certify that a specified State is a contracting State and that any place or territory forms part of a State so specified are conferred on Her Majesty. The British side proposes that these powers should be exercised.by the Governor, as in the case of the localisation of laws proposal in relation to the limitation of shipowners' liability.

Under the 1982 Order, the Secretary for Monetary Affairs in Hong Kong may specify in Hong Kong dollars the amounts to be taken as equivalent for a particular day to sums expressed in the Rules in special drawing rights. The British side proposes to retain this provision as it is already suitable for Hong Kong's circumstances, but to confer the functions on the Hong Kong Monetary Authority which was established on 1 April 1993.
