This Clause will provide that Clause 73 as based on EPC Articles 83, 84 and 85, relating to the description of the invention, the claims, any drawings referred to in the description or the claims and the abstract will apply to petty patents. It will also provide for Rules to be made under Clause 120 dealing with :

(a)

the content of the description to be based on EPC Rule 27

suitably adapted to take note of any specific requirements for Hong Kong;

(b)

the form and content of claims to be based on EPC Rule 29 suitably adapted to take note of any specific requirements for Hong Kong;

the form of the drawings which will include provisions to be based on EPC Rule 32 suitably adapted to take note of any specific requirements for Hong Kong; and

the form and content of the abstract which will include provisions based on EPC Rule 33 suitably adapted to take note of any specific requirements for Hong Kong.

This clause will provide, based on EPC Rule s. 34, suitably adapted to take note of any specific requirements for Hong Kong, that the Registrar may exclude certain prohibited matter from the petty patent specification when published.

This clause will provide that an application for the grant of a petty patent may be withdrawn at any time before the petty patent is granted and that any withdrawal of such application may not be revoked.

Minimum requirements to obtain a date of filing a petty patent application

This clause will provide that the date of filing the petty patent application will be the date on which the applicant lodges with the registry :

(a)

an indication that a petty patent is sought;
