Privilege for communications with patent agents relating to patent proceedings

This clause will contain provisions based on 1988 Act s. 255 (1) to (3), suitably adapted to take note of any specific requirements in Hong Kong, declaring that a communication between a person and a person who is entered on the register of patent agents under Clause 118 or a person who is on the European list shall be privileged from disclosure in legal proceedings in Hong Kong in the same way as a communication between a person and his solicitor. Such legal proceedings will not include criminal proceedings but will include proceedings before the Registrar.

Power of Registrar to refuse to deal with certain agents

This clause will contain provisions based on 1988 Act s. 256 (2) and (3), suitably adapted to take note of any specific requirements in Hong Kong, authorising the Registrar to refuse to recognise an agent in certain circumstances.

Correction of errors in HK patents and requests to record

1977 Act s.117

This clause will contain provisions based on the 1977 Act s. 117, suitably adapted to take note of any specific requirements in Hong Kong, to enable the Registrar to correct any clerical errors or mistakes in any specification of a patent or in the request to record or the application for a HK patent or any document filed in connection with a patent etc. or any error of translation or transcription. Where the Registrar is requested to make such a correction any person may oppose.
