Compensation of employees for certain inventions
This clause will deal with the question of compensation for employees in respect of certain inventions which it is proposed will be based on the 1977 Act s.40 suitably adapted to take note of any specific requirements in Hong Kong. It is proposed that application would be made to the court and that all the relevant circumstances of the case should be taken into account and not merely the terms of the contract.
Amount of compensation
This clause will deal with the calculation of the amount of compensation payable under an award for compensation under Clause 38. It is proposed that this will be based on the 1977 Act s.41 suitably adapted to take note of any specific requirements in Hong Kong.
Enforceability of contracts relating to employees' inventions
This clause will deal with the enforceability of contracts between the employer and employee. It is proposed that this will be based on the 1977 Act s.42 suitably adapted to take note of any specific requirements in Hong Kong.
Supplementary
It is proposed that this will be based on the 1977 Act s.43 suitably adapted to take note of any specific requirements in Hong Kong.
