The legislation will have extraterritorial effect in

that it will prohibit

dumping at sea outside the waters of Hong Kong from a Hong Kong vessel, a Hong Kong aircraft, a Hong Kong hovercraft or a Hong Kong marine structure;

(b)

deposits from a container floating in the sea which is controlled by any such vessel, aircraft or structure;

(c)

towing or propelling from Hong Kong or from the waters of Hong Kong a vessel for scuttling anywhere at sea.

The Bill will also

incineration of substances or articles anywhere at sea if the incineration takes place on Hong Kong vessel or Hong Kong marine structure. The Chinese side will appreciate that these extraterritorial provisions are required in order to implement in Hong Kong law the terms of the Convention.

Future adaptation

9.

Nearer to 1997 certain modifications to the Ordinance

will be required to ensure that it does not contravene the Basic Law. The British side will in due course consult the Chinese

side on any such amendments in accordance with the agreed principles for consultation on adaptation of laws.
