Thank you for copying to me your letter of 30 November and enclosures. I have discussed the proposed approach briefly with Murray Sinclair of Scottish Office Solicitors and our main immediate reaction is one of concern that the list of offences approach has been adopted; this is, of course, contrary to the approach of the Extradition Act 1989 and indeed of more recent pre-1989 treaties (eg Spain). I understand from Wendy Wyver that Home Office have expressed similar concerns and that this approach is being reconsidered. I think any other points of Scottish detail can probably best be deferred until we are clear as to what approach is being taken.
